These Terms of Service govern your use of services provided by The Packaging Butler LLC. By submitting inventory, placing an order, or using our services, you (“Client,” “you”) agree to be bound by these Terms.

1. Description of Services

The Packaging Butler provides packaging, prep, fulfillment, and related logistics services, including but not limited to:

  • Amazon FBA prep services

  • Labeling and relabeling

  • Poly bagging and protective packaging

  • Bubble wrapping and fragile prep

  • Bundling and kitting

  • Receiving and inspection

  • Carton packing and shipment preparation

  • Direct-to-customer fulfillment

  • Corporate, event, and non-profit packaging services

Services are performed based on information and instructions provided by the Client.

2. Client Responsibilities

The Client agrees to:

  • Provide accurate, complete, and timely instructions

  • Ensure products are legal, safe, and compliant with marketplace and carrier requirements

  • Verify products are eligible for Amazon FBA or other platforms

  • Comply with all applicable laws, regulations, and platform policies

The Packaging Butler is not responsible for errors resulting from incomplete or inaccurate client information.

3. Inventory Ownership & Risk

  • All inventory remains the property of the Client at all times.

  • Risk of loss transfers to the Client upon carrier pickup.

  • The Packaging Butler is not responsible for manufacturing defects, recalls, or product liability.

4. Receiving & Inspection

  • Inventory is visually inspected upon receipt.

  • We do not test functionality unless specifically agreed upon in writing.

  • Discrepancies must be reported within 48 hours of notification.

5. Amazon & Marketplace Compliance

While we follow platform prep guidelines, final compliance responsibility rests with the Client.
We are not responsible for:

  • Amazon or marketplace rejections

  • Fees, penalties, or policy changes

  • Listing or ASIN restrictions

  • Delays during platform check-in

6. Fees & Payment

  • Fees are based on services requested and performed.

  • Pricing is subject to change with notice.

  • Payment is due prior to or upon completion of services unless otherwise agreed.

  • Unpaid balances may delay services or shipments.

7. Refunds & Cancellations

Services are labor-based and custom. Once work begins, services are non-refundable.
Refund eligibility is governed by our Return & Refund Policy, incorporated herein by reference.

8. Storage

  • Limited short-term storage may be provided at our discretion.

  • Extended storage may incur additional fees.

  • Inventory left unclaimed for 30+ days may be subject to storage fees or disposal after notice.

9. Client-Supplied Materials

The Packaging Butler reserves the right to reject:

  • Non-compliant or damaged boxes

  • Unsafe or prohibited items

  • Inventory not suitable for handling or storage

Repacking or replacement materials may incur additional fees.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Our liability is limited to the amount paid for the specific service in question.

  • We are not liable for indirect, incidental, or consequential damages.

  • We are not responsible for carrier delays, losses, or damages.

11. Indemnification

The Client agrees to indemnify and hold harmless The Packaging Butler from any claims, damages, or liabilities arising from:

  • The Client’s products

  • Platform policy violations

  • Inaccurate instructions

  • Legal or regulatory issues related to the inventory

12. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, labor disputes, carrier disruptions, or government actions.

13. Termination of Services

The Packaging Butler reserves the right to refuse or terminate services at any time for:

  • Policy violations

  • Non-payment

  • Unsafe or prohibited inventory

  • Repeated compliance issues

14. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.

15. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of services constitutes acceptance of updated Terms.
